General

These Terms of use govern, together with the Privacy Policy, your use of the FITMATE Health & Fitness Coaching Programme delivered via iOS and Android Apps, WhatsApp Messaging, SMS and the FITMATE Website (the ”Programme”) and related services provided by FITMATE (”Us”, ”We”).

This FITMATE Health & Fitness Coaching Programme is owned and operated by Pikmate Ltd, a UK registered company with registration number UK12536406 and registered address Gothic House, Barker Gate, Nottingham, England, NG1 1JU

By using the Progamme you confirm and affirm that you have read, understood and agree to these Terms of Use. If you do not agree to these Terms of Use, do not use the Programme.

The Programme and all related trademarks, logos, software and other intellectual property rights are and shall remain our exclusive property. Your right to use the Programme and its content is personal, non-exclusive, non-sublicensable and non-transferable. Any copying, republication or redistribution of the Programme or any of its content is strictly prohibited.

Disclaimer Of Warranty

The Programme and all of its content are provided on an ”As Is” and ”As Available” basis and We do not provide any assurances of the availability or usability by you of the Programme.

Limitation Of Liability

We shall not be liable for any errors in any content, actions taken, injuries or and misfortunes that may occur when you are using our content. We shall not be liable to you for any interception of online communications, software or hardware problems (including, without limitation, viruses, loss of data or compatibility conflicts).

Furthermore, when joining our program, you have agreed to the assumption of risk, waiver and release of liability.

FITMATE Program Subscription

You can sign up for a monthly rolling subscription or various upfront commitment subscriptions. The start date of your subscription is the payment date, and we’ll take payment at the beginning of your rolling month. Your monthly subscription may auto-renew unless you cancel it.

When you subscribe to the FITMATE Programme, you must designate and provide information about your preferred payment method. We use STRIPE and PAYPAL payment methods to enhance your security. This information must be complete and accurate, and you are responsible for keeping it up to date. You expressly authorize us to collect via automatic charges the appropriate fees charged for the FITMATE programme.

If you do not pay the fees or charges due for your use of the FITMATE programme, we may make reasonable efforts to notify you and resolve the issue; however, we reserve the right to disable or terminate your access to the FITMATE programme (and may do so without notice).

Termination Or Cancellation

You may at any time terminate your membership, in which case your membership will still be valid for the subscription time you have already paid for. You can cancel at any time by writing to your personal coaching team member. Once you have cancelled your FITMATE program and received confirmation, no other changes can be made to your account. The cancellation of a FITMATE program will go into effect at the end of your current billing cycle, and you will have the same level of access to the FITMATE program through the remainder of such billing cycle. For example, if you are billed on a monthly basis and cancel during a given month, you will be charged for the entirety of that month and maintain access to the FITMATE program through to the end of that month.

There are no refunds for termination or cancellation of your FITMATE program. If you no longer wish to subscribe to the FITMATE program, it is your responsibility to cancel your program in due time, regardless of whether or not you actively use the FITMATE program.

We reserve the right to change the subscription fees from time to time

Miscellaneous

We reserve the right to, from time to time, in our sole discretion amend these Terms of Use. It is your responsibility to review these Terms of Use from time to time to understand the extent of changes. Your continued use of the Programme constitutes your agreement to the amended and updated Terms of Use.
